Terms of Use - KM Tracking App

1) LICENSE GRANT

Cypher Novus PLT grants you a revocable, non-exclusive, non-transferable, limited license to download and use the application for personal or business record-keeping purposes, subject to these terms.

2) Record Keeping & Tax Compliance

You are advised to retain all original receipts and supporting documents for at least seven (7) years, in accordance with the Income Tax Act 1967 (Malaysia). All records, calculations, and reports generated by this app are provided for reference and record-keeping purposes only.

3) USER RESPONSIBILITY

You are solely responsible for:

• Ensuring all entered data is accurate, complete, and truthful.

• Reviewing and verifying all reports before use or submission.

• Ensuring compliance with applicable tax laws, regulations, and reporting requirements.

Cypher Novus PLT does not provide tax, legal, or accounting advice.

4) Data Storage & Backup

Free version:

• Data is stored locally on your device only.

• Data cannot be exported.

• Data may be permanently lost if the app is removed or the device is lost.

5) Subscriptions & Billing

The app offers auto-renewing Pro subscriptions (Monthly/Yearly). Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Cypher Novus PLT does not process payments directly; all refunds and cancellations must be managed through your respective app store settings.

6) Disclaimer of Warranties

The application is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation.

• Complete accuracy of calculations.

• Perfect data preservation under all circumstances.

7) Limitation of Liability

To the maximum extent permitted by law, Cypher Novus PLT shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

• Tax penalties, audit outcomes, or assessment adjustments.

• Loss of data.

• Loss of profits or business opportunities.

By downloading or using KM Tracking App (“the app”), provided by Cypher Novus PLT, you agree to the following Terms of Use.

Pro version:

• Users may manually export backup files to a location of their choice (e.g., Cloud Storage, External Drive, etc.).

• The safekeeping of this backup file is the sole responsibility of the user.

• If a backup is not saved externally, data may be permanently lost due to device loss, reset, or app removal.

8) Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia.

9) Language & Governing Version

In case of any inconsistency, the English version shall prevail.
